PHOTOGRAPHY SERVICES AGREEMENT

Parties and Session
This agreement is between Sarah MacDonell, professionally known as Luna Rose Armaris (“Photographer”) and the client identified below (“Client”). It applies only to the session and deliverables described in this agreement.
1. Scope of Services
The Photographer will provide the photography services selected by the Client at the agreed date, time and location. The Photographer retains creative control over posing, lighting, composition, selection and editing consistent with the Photographer’s portfolio and professional judgment.
2. Fees, Reservation and Payment
The total fee and payment schedule will be written below. A stated reservation payment may be non-refundable because the Photographer reserves the date and declines other work. The remaining balance is due by the date written in this agreement. No final images are delivered until amounts due are paid.
3. Cancellation, Rescheduling and Late Arrival
The Client must provide reasonable written notice to cancel or reschedule. Reservation payments are applied according to the written cancellation terms below. Weather, illness, emergencies and circumstances outside either party’s reasonable control will be handled in good faith. Late arrival may reduce shooting time without reducing the agreed fee.
4. Image Selection, Editing and Delivery
The Photographer selects the images that meet artistic and technical standards. Unedited files and rejected images are not included unless agreed in writing. The estimated delivery window appears below and may be reasonably extended for illness, emergencies, technical issues or unusually large projects. The Client should download and back up delivered files promptly.
5. Copyright and Client License
The Photographer retains copyright in the photographs unless copyright is expressly transferred in a separate signed writing. After full payment, the Client receives a non-exclusive license for the uses selected below. The Client may not sell, materially alter, apply filters to, remove watermarks from or commercially exploit images without written permission.
6. Portfolio and Promotional Use
The Photographer will use identifiable images for portfolio, website, social media or advertising only according to the separate model-release choices signed by the Client or photographed person. Declining promotional permission does not affect photography services unless the project is expressly arranged as a portfolio collaboration or TFP session.
7. Safety, Cooperation and Conduct
All participants agree to communicate boundaries, follow reasonable safety instructions and behave respectfully. The Photographer may pause or end a session for unsafe, illegal, harassing, threatening or non-consensual conduct. The Client is responsible for supervising minors and obtaining any required location permissions.
8. Limitations and Uncontrollable Events
The Photographer will take reasonable care with equipment and files. If performance or delivery becomes impossible because of serious illness, equipment failure despite reasonable precautions, data loss, venue restrictions, severe weather or another event beyond reasonable control, the parties will work toward rescheduling, replacement services or a refund limited to amounts paid for undelivered services, as appropriate and permitted by law.
9. Entire Agreement and Changes
This agreement, the selected session details and any attached release form constitute the parties’ understanding. Changes must be made in writing and accepted by both parties. If one provision is unenforceable, the remaining provisions continue to the extent permitted by law.
